B.5.0 • Guiding Principles
This section of the CARFAC-RAAV Minimum Recommended Fee Schedule establishes guidelines for royalties paid to visual and media artists for reproductions made of their artworks for commercial/advertising purposes; that is, when the work is reproduced in conjunction with a product or institution, rather than when the work is reproduced for itself as a work of art. For non-advertising and non-commercial royalties, please see Section 2.
B.5.0.1 What the Royalty covers
A Reproduction Royalty is compensation for the audio-visual, digital, or print reproduction of an artwork. A Reproduction Royalty is compensation for the audio-visual, digital, or print reproduction of an artwork. All royalties listed here are considered minimum recommendations. An artist may request a higher royalty, or they may accept a higher royalty if it is offered. All royalties are payable in Canadian dollars, and they are exclusive of applicable taxes.
Copyright collectives, such as Copyright Visual Arts may request higher royalties for their affiliated artists.
Additional exhibition royalties or professional services fees may apply. Royalties do not include:
- general equipment (ie: lights, projectors, video, audio, etc) that should be provided by the presenting organization. Special equipment integral to the work is the responsibility of the artist, however, if an artist is supplying their own equipment, equipment rental fees should be added. Rental fees for artists’ equipment should match those of the nearest production centre offering similar equipment.
- publication costs, insurance, shipping, or any other costs associated with the production of an exhibition or other activity.
- costs related to the production of artwork(s), which should remain negotiable.
- artists’ travel and accommodation expenses, or per diems payable to the artist so they may attend a site visit, install work, give an artist talk or workshop, attend a reception, etc.
- presentation, consultation, jury, writing, installation, or preparation fees. Refer to Section 4 Artist Professional Services Fees.
If an artist receives a prestigious award or cash prize, all exhibition and reproduction royalties and professional services fees are to be considered separate from the award amount.
B.5.0.2 What a copyright license covers
A license entitles a user to exhibit or reproduce or use a work in a specified manner. Ownership of a work does not imply a transfer of copyright. Copyright remains the property of the artist unless there is an agreement that states otherwise. We recommend that artists license their rights, rather than assign them.
Moral rights protect a work from associations with unapproved causes or products, and from unapproved alteration or distortion (including overprinting and cropping). They also require that an artist be credited with their creation, unless the artist does not wish to be associated with it.
B.5.0.3 Size of a presenting organization
Unlike rates in the Exhibition and Screening Royalty schedule, we do not currently recommend different rates for Reproduction Royalties according to the host venue’s organizational budget, but some exceptions apply:

B.6.0 • Exhibitions at Trade Fairs, Salons, and Conventions
This category applies to exhibitions taking place within the framework of a commercial trade fair, salon, or convention not principally dedicated to the sale of the work itself. Rates apply equally to original works of art and to reproductions.
The rate for a full square metre is added for any portion of an additional square metre. Royalties cover exhibition and reproduction rights for one exhibition up to six months in duration.

B.7.0 • Audio-Visual Reproductions
B.7.1 Trailers (Cinema, Television)
The rates given are for a license of one year duration. If trailers are used for one month or less, the royalty is 25% of the listed amount. Royalties are based on the duration of the appearance of the image. They are the same regardless of whether the image is fixed or moving. The rates for not-for-profit cultural organizations are 50% of the royalties listed. The license covers uses in all languages and for all audiences, including personal use, and remote transmission.

These rates apply to projections or walls of images presented in a promotional or public relations context.
‘Number of works’ generally refers to the number of images included in a reproduction license. If a license includes works by several artists, ‘number of works’ would refer to the number of images contributed by each artist, for the purposes of calculating the royalties.

B.8 • Digital and electronic reproductions
All use of a work of art on the internet is considered advertising if the use is not principally for the promotion of the work itself, the artist, or a collection or exhibition of which the work is part.
B.8.1.1 Internet – Moving Images
If an extract is used on the banner page, the rate given below is doubled. When the duration of the use exceeds three months, each part of a month counts as a whole month. Licenses are issued to cover a maximum of one year duration. A new license must be issued after one year.

B.9 • Print Reproductions
The royalties are for advertising and commercial uses, including brochures promoting a museum. Authorization for reproduction is usually for a specific print run. The rightsholder has the right to demand and receive proof of the print run, such as a copy of the print invoice.

B.9.2 Magazines, Journals, Periodicals, Newspapers
If an image is on the cover of an inside section of a newspaper, the back-cover rate applies. If the cover image is less than 1/3 of a page, the full-page rate applies.
The image size is determined by the size of the advertisement in relation to the whole page. If the image is used on several different supports, the size is calculated in relation to the average size of the supports. Print runs in various publications can be combined to determine the royalty category for a single advertisement.

B.9.6.2 Calendars and agendas offered for sale
When the calendar or agenda contains works by one artist only, the royalty is 15% of the retail price of the entire print run, payable in advance.
When the calendar or agenda contains works by more than one artist, the royalty is determined by dividing 15% of the retail price of the print run by the number of images (to get a rate per image), multiplied by the number of works by artists. The total amount paid to all participating artists must not be less than 15% of the retail price of the print run.

B.9.7 Objects bearing reproductions
This category includes items such as puzzles, crockery, t-shirts, and souvenir items, that are used for advertising or promotion. Advertising objects are those that highlight, along with an image of a work, the name of a person, company or organization other than the artist. It may also include a reproduction of an artwork on fabric.
In some instances, royalties for commercial edition projects may take the form of an advance payment plus a percentage of the proceeds of sale.
The royalties listed apply to licenses for use within Canada. For worldwide rights, the rate is doubled. For North American rights, the rate is increased by 50%.
