Section 2 – 2024 Reproduction Royalty Schedule – Non-commercial, Non-advertising
B.1.0 • Guiding Principles
This section of the CARFAC-RAAV Minimum Recommended Fee Schedule establishes guidelines for royalties paid to visual and media artists for reproductions made of their artworks for non-commercial, non-advertising purposes; that is, when the work is reproduced for itself as a work of art, and not presented in conjunction with a product or institution. For advertising and commercial royalties, please see Section 3.
B.1.0.1 What the Royalty covers
A Reproduction Royalty is compensation for the audio-visual, digital, or print reproduction of an artwork. All royalties listed here are considered minimum recommendations. An artist may request a higher royalty, or they may accept a higher royalty if it is offered. All royalties are payable in Canadian dollars, and they are exclusive of applicable taxes.
Copyright collectives, such as Copyright Visual Arts may request higher royalties for their affiliated artists.
Additional exhibition royalties or professional services fees may apply. Royalties do not include:
- general equipment (ie: lights, projectors, video, audio, etc) that should be provided by the presenting organization. Special equipment integral to the work is the responsibility of the artist, however, if an artist is supplying their own equipment, equipment rental fees should be added. Rental fees for artists’ equipment should match those of the nearest production centre offering similar equipment.
- publication costs, insurance, shipping, or any other costs associated with the production of an exhibition or other activity.
- costs related to the production of artwork(s), which should remain negotiable.
- artists’ travel and accommodation expenses, or per diems payable to the artist so they may attend a site visit, install work, give an artist talk or workshop, attend a reception, etc.
- presentation, consultation, jury, writing, installation, or preparation fees. Refer to Section 4 Artist Professional Services Fees.
If an artist receives a prestigious award or cash prize, all exhibition and reproduction royalties and professional services fees are to be considered separate from the award amount.
B.1.0.2 What a copyright license covers
A license entitles a user to exhibit or reproduce or use a work in a specified manner. Ownership of a work does not imply a transfer of copyright. Copyright remains the property of the artist unless there is an agreement that states otherwise. We recommend that artists license their rights, rather than assign them.
Moral rights protect a work from associations with unapproved causes or products, and from unapproved alteration or distortion (including overprinting and cropping). They also require that an artist be credited with their creation, unless the artist does not wish to be associated with it.
B.1.0.3 Size of a presenting organization
Unlike rates in the Exhibition and Screening Royalty schedule, we do not currently recommend different rates for Reproduction Royalties according to the host venue’s organizational budget, but some exceptions apply:

B.2.0 • Audio-Visual Reproductions
B.2.1 Reproduction within a cinematographic work
A cinematographic work may be a work of fiction, a documentary, or a work of art, on film, videotape, or digital support. Works originally made on film remain classified as works on film even if the image has been transferred to videotape or digital support. This category includes all productions intended for broadcast.
B.2.1.1 Reproduction of a fixed image in a cinematographic work
The license permits public viewing in local or regional broadcasts. For national or international broadcasts, the royalties are doubled. The license includes all languages, and all types of distribution (screening, broadcast, video sales, etc.). For major productions, the royalty may be tripled.
The royalties are calculated for a 5-year license. For a 10-year use, the basic rate is multiplied by 1.5. For a 25-year use, the basic rate is multiplied by 2.5.
For works used in a documentary profile of an artist, the following rates apply, but the length of the license is increased to in perpetuity.
‘Number of works’ generally refers to the number of images included in a reproduction license. If a license includes works by several artists, ‘number of works’ would refer to the number of images contributed by each artist, for the purposes of calculating the royalties. For special projects where a number of works by the same artist are used, a nominal royalty of $300 may be offered.
For non-profit cultural or educational projects, the royalty is reduced by 50%, or the conditions negotiated.
Royalties do not cover the use of work for promotion of the project. For such uses, Commercial Reproduction royalties apply.

B.2.1.3 Reproduction of a moving image or audio work in a cinematographic work
The royalties below are calculated for a 10-year period. The licenses include all territories, languages, and all types of distribution.
The rates are paid per work. For several extracts of the same work in the same project, total duration is used to calculate the rate.
The royalties do not cover promotional uses. For promotional items, such as posters, T-shirts, publicity, commercial reproduction rates apply. See Section 3.

B.2.2 Public Projection and Audio Presentation
Licenses are required for the public projection of slides, transparencies, and audio presentations of digital or like formats reproducing original works. These rates do not apply to original works conceived as projections (see Exhibition and Screening Royalties).

B.2.2.1 Projection of a fixed image
These royalties apply when an artist’s work is projected in a public presentation, such as a lecture, panel presentation, or workshop. The rates given below are per image. The rates are for copyright licensing only and do not include material costs or purchase costs related to creating or sharing a reproduction.

B.2.2.2 Projection of video, film, or electronic art
These royalties apply to the projection of film, video, or electronic art in a public, non-exhibition, screening, or audio presentation context, such as a lecture, panel presentation, or workshop. Royalties for media art in public exhibitions or screening/presentation contexts are found in the Exhibition and Screening Royalty schedule.
For educational use of media artworks, where an educational institution purchases physical copies and a long-term license of media art for use in a specific institution’s context, or where they purchase a streaming license of a digital file for online learning platforms, refer to Section 2 of the Independent Media Arts Alliance (IMAA) fee schedule.
Please note that if a work is obtained from a distributor, royalties rates may differ and will be included in the distribution agreement and paid to artists by the distributor.

B.2.3 Reproductions in photographic or digital formats for private use
This category permits the reproduction of work in photographic or digital formats where the reproduction is intended for sale for private use only. Such private use includes consultation in a library or archive.
Where such reproductions are purchased for public presentation or for use in television, video, or film, use rates given in B.2.2.

B.3 • Digital and Electronic Reproductions
B.3.0 Internet
These royalties apply to the presentation of a digital reproduction of a work on the internet, considered to be an electronic publication. For exhibitions of works of art conceived for the internet, please use Exhibition and Screening Royalty schedules.
Internet use is necessarily worldwide, so licenses are issued for worldwide use.
Licenses specify parameters of digitization and electronic publication (i.e. maximum dpi, protection against unauthorized downloading, etc). Removal of the image from a database or website is required once the license is expired.
These are non-commercial, non-advertising rates. They apply where the user organization (collectives, museums, artist-run centres and so on) has a mandate to promote visual or media art and/or artists. For all other types of use, please refer to the commercial rates in Section 3.
The rates given are per work. ‘Number of works’ generally refers to the number of images included in a reproduction license. If a license includes works by several artists, ‘number of works’ would refer to the number of images contributed by each artist, for the purposes of calculating the royalties.
B.3.1 Digital reproductions related to exhibitions and screenings
For exhibitions where CARFAC-RAAV exhibition and screening royalties have been paid, or when an artist is paid above these guidelines, discounted rates for digital promotion of the work are available for reproductions directly promoting the exhibition.
A royalty of $25 per work per support is recommended for the following digital reproductions: e-invitations, website posts, electronic brochures, mobile applications, not-for-sale digital exhibition catalogues, and publicity in journals or periodicals. A $25 royalty per work per support is also recommended for print reproductions – see B.4.1. Alternatively, a $500 flat fee for unlimited exhibition-related print and digital reproductions applies. In all cases, the special rate does not apply to digital or print reproductions that are offered for sale.
For social media, the royalty of $25 is a flat fee per artist whose work(s) are used, per platform. For all other uses, the royalty is paid for each usage.

B.3.2 Moving images on the internet
This category includes video or film works, interactive works, and sound works. If an extract is used on a banner page of a website, the applicable royalty is doubled. If the work is to be included in an online exhibition, exhibition royalties are due. See Exhibition and Screening Royalty Schedule. If the work is used to promote an exhibition or screening where CARFAC-RAAV royalties are met, refer to B.3.1.
Licenses are issued for up to one year. Longer licenses may be negotiated. For the inclusion of non-interactive video, film or sound works in archives or long-term projects, the royalty is $250 per work, for a five-year license. For the inclusion of interactive works in archives or long-term projects, the royalty is $250 per work, per year.

B.3.3.0 Fixed images on the internet
These rates are for non-commercial, non-advertising uses by non-profit organizations with a cultural mandate. All others should use the rates listed in Section 3. If the work is used to promote an exhibition or screening where CARFAC-RAAV royalties are met, refer to B.3.1.
All royalties are flat rates for the duration of the use, payable per artist/per image/per use, unless otherwise stated.
For the security of images on the internet, it is recommended that images be used at a resolution of 72 dpi, that watermarks be placed on images if possible, and that a copyright notice be placed in proximity to the image.
The royalty for uses related to exhibition promotion where CARFAC/RAAV-level exhibition royalties have been paid, the rate is $25 per work. See B.3.1.
For images posted on a museum website, and not part of an exhibition where CARFAC-RAAV royalties are met, the rate is $50 per work. If an artwork appears on a homepage or in the foreground, the rate is $100. Digitizing and archiving of the work is included.
For images posted on a museum intranet terminal, interactive installations, media-guides and other derivative involving a scan for public communication, the rate is $30 per work. If an artwork appears on a homepage or in the foreground, the rate is $60. Digitization of the work is included.
For works included in an online catalogue of a collection, an online archive, or database where little interpretation beyond simple identification of the work is offered, or in a pdf-style publication, the following rates apply, subject to a limited duration of 5 years; the rate is doubled for use in perpetuity:

The rates above are a one-time fee for each artist whose works are used. For example, if a gallery shares five works from their permanent collection on a database, the rate is a one-time payment of $300 for a 5 year use for all five works by that artist, or $600 if there is no time limit on the use.
If a work is used in more than one location on a website, 20% is added for each additional use. For works appearing on a home page, the rate is doubled. For a network intranet, or an internet site with limited access (i.e. password subscription), the applicable rate is $50.
For online exhibitions of still-image works, illustration of non-advertising texts, or other projects which offer interpretation of the work, the rate is $50 per work per use.

For Mobile Applications and other derivatives involving a scan for public communication either within a presenting institution or to be downloaded for private use, the rate is $50 per work. If an artwork appears in the foreground, the rate is doubled. Digitization of the work is included, and there is no limit on the number of media. For images posted on social media platforms such as Facebook, Twitter, YouTube, Google+, Instagram, Pinterest, Linkedin, Snapchat, etc, the royalty is $25 per work, per platform. Digitizing and archiving of the work are included.

B.3.3.3 Electronic newsletters, press releases, and blogs
For images posted in an electronic newsletter, press release, blog, annual reports, invitations, etc., the royalty is $50 per work, per posting or mailing, with no limit on the number of recipients. If the image is an installation view of the work, the rate is a flat fee of $30 per artist whose work(s) are used. Digitizing and archiving of the work are included.

This section deals with e-Catalogues, e-magazines, e-books, etc. sold online or distributed online for free. If the work is used to promote an exhibition or screening where CARFAC-RAAV royalties are met, refer to B.3.1.
B.3.4.1 Digital publications distributed for free
The royalty is $50 per work. The royalty for a cover reproduction is $170 per work. These rates are subject to a limited duration of one year. A longer-term duration is to be negotiated.

The royalties listed are for use on a CD-ROM, DVD, USB, or other digital media, distributed within Canada. For North American use, add 50%. For worldwide use, the rate is doubled. For educational uses, the rates are reduced by 50%. If the work is used to promote an exhibition or screening where CARFAC-RAAV royalties are met, refer to B.3.1.
In some circumstances, royalties may be paid in the form of an advance payment upon a signed agreement, and/or may include a percentage of the proceeds of sale.

B.4 • Print Reproduction
The royalties are for non-advertising uses. Please see Section 3 for advertising and commercial uses. Non-advertising use includes items bearing reproductions promoting the work itself, the artist, or an exhibition including the work. Other promotional items, such as brochures promoting a museum, greeting cards promoting an organization, etc. must use applicable advertising schedules.
Authorization for reproduction is usually for a specific print run. The rightsholder has the right to demand and receive proof of the print run, such as a copy of the print invoice.
B.4.1 Print reproductions related to exhibitions and screenings
For exhibitions where CARFAC-RAAV exhibition and screening royalties have been paid, or when an artist is paid above these guidelines, discounted rates for digital promotion of the work are available for reproductions directly promoting the exhibition.
A royalty of $25 per work per support is recommended for the following print reproductions: promotional invitations, tickets, print brochures, press kits, newsletters, signage, banners, posters, and annual reports. A $25 royalty per work per support is also recommended for digital reproductions – see B.3.1. Alternatively, a $500 flat fee for unlimited exhibition-related print and digital reproductions applies. In all cases, the special rate does not apply to digital or print reproductions that are offered for sale.

B.4.2 Publications
B.4.2.1 Books and catalogues offered for sale
The following royalty applies to all books offered for sale, including exhibition catalogues, art books, textbooks, and illustrated books.
For the front or back cover of a book, the royalty is $325. If more than one image appears on a cover, the full rate is applied to each image.
Royalties for image use inside the catalogue or book are based on the retail price and print run of books available for retail sale (ie: sold in a museum gift shop) and print run of books not available for retail sale (ie: retained by the museum staff, distributed to other museums or libraries, etc), as well as the number of pages containing an artist’s illustrations and the number of pages containing an artist’s work.

If the calendar or agenda contains works by one artist only, the royalty is 10% of the retail price of the entire print run, payable in advance. When the calendar or agenda contains works by more than one artist, the royalty is determined by dividing 10% of the retail price of the print run by the number of images (to get a rate per image), multiplied by the number of works by artists. The total amount paid to all participating artists must not be less than 10% of the retail price of the print run.

Royalties for images on billboards not used for advertising purposes are $826 per billboard for 1-10 sites, for a duration up to three months. Discounted rates for additional billboards are negotiable.

This category includes items such as puzzles, crockery, t-shirts, souvenir items, etc. that do not have an advertising function – only the name of the artist or the title of the work may appear. It may also include reproductions of an artwork on fabric. Items promoting anything other than the artist or the work must use Section 3.
In some instances, royalties for commercial edition projects may take the form of an advance payment plus a percentage of the proceeds of sale.

Royalties cover the reproductions included in the press packets distributed to print, electronic, or other media. The license and rates apply only to the institution distributing the press packet and not to the use by media or other third parties.
Up to 2 additional images, not included in the packet but available to the press upon request, may be added at the rates listed. Additional “on-demand” reproductions require an updated license, if not originally included, at a rate of $10 per image.
